Definitions

1.1. “Account” means an account that you will need to register for on the Site if you would like to submit an Order on the Site.

1.2. “Business” means the online business of selling through the Site.

1.3. “Business Day” means any day on which banks are open for business other than Saturday, Sunday and gazetted public holidays in Malaysia.

1.4. “Contract” means your Order of a Product or Products complying with these Terms and Conditions that we accept in accordance with Clause 3.2 below.

1.5. “Customer” means an individual who places an Order on the Site.

1.6. “Minimal Requirement” means your required status in accordance with Clause 2 below.

1.7. “Order Confirmation” means our email to you confirming the acceptance of your purchase in accordance with Clause 3.2.4 below.

1.8. “Order” means the order submitted by you to the Site to purchase Product(s) from us.

1.9. “You” means the Customer visiting the Site and placing an Order.

1.10. References to “Clauses” are to clauses of these Terms and Conditions.

2. Minimal Requirement

2.1. You must be over 18 years of age at the time of the Contract; and

2.2. You must possess a valid credit or debit card issued by any bank that is acceptable by the Company; or

2.3. You must maintain a valid and active online banking facility with a bank acceptable by the Company.

3. Terms of Sale

3.1. You must have a valid and active email address when registering on the Site, which will be the mode of communication between you and the Site and its personnel. All information, updates, Order Confirmations, delivery address confirmations, and other related matters will be communicated via the said email. You must also provide valid contact details, including your corresponding address, telephone number, and payment details.

3.2. Contract Formation

3.2.1. You agree to pay the price of the Product that you ordered, including any applicable delivery charges displayed on the Site.

3.2.2. Payment for the Product must be made in full at the time of ordering by the methods stipulated in Clauses 2.2 or 2.3. Alternate payment methods may be introduced from time to time.

3.2.3. We reserve the right to validate your payment details before providing the Product.

3.2.4. A Contract shall be formed when we expressly accept your Order by sending you an Order Confirmation email.

3.2.5. If you discover that you have made a mistake with your Order after submission, please contact our customer care department immediately. However, we cannot guarantee that amendments can be made.

3.2.6. A Contract relates only to those Products whose dispatch has been confirmed in the Order Confirmation.

3.2.7. You must provide accurate and up-to-date information and notify us of any changes.

3.3. Price and Payment

3.3.1. Whilst we make every effort to ensure that all details, descriptions, and prices on this Site are accurate, errors may occasionally occur.

3.3.2. Delivery costs, where applicable, will be clearly displayed and included in the final total.

4. Delivery Process

4.1. At present, all orders are shipped using our courier partner, City Link.

4.2. Users will not be notified of future courier partner changes.

4.3. Orders will be dispatched within 24–48 hours after receipt.

4.4. No shipments will be processed during weekends or Malaysian public holidays.

5. Cancellation

5.1. We may cancel a Contract if a Product is unavailable for any reason. We will notify you and allow you to select another item from CosmoCosmetic.

5.2. There are no refunds with CosmoCosmetic. We currently offer returns and exchanges only.

5.3. Orders confirmed via an Order Confirmation cannot be cancelled unless otherwise approved in writing by our customer care department.

6. Returns and Refunds

6.1. There are no refunds on any orders placed with CosmoCosmetic. Exchanges are permitted upon submission of the following:

6.1.1. A photograph showing the defective product or incorrect item.

6.1.2. Invoice number, Order number, and tracking number.

6.1.3. Name of the item.

7. Force Majeure

7.1. We shall not be liable for any breach, hindrance, or delay in the performance of a Contract resulting from causes beyond our reasonable control, including but not limited to natural disasters, unavoidable incidents, actions of third parties (including hackers, suppliers, governments, quasi-governmental, supranational or local authorities), riots, civil unrest, war, terrorism, piracy, strikes, epidemics, fires, explosions, storms, floods, droughts, earthquakes, mechanical breakdowns, third-party software failures, utility failures (including electricity, telecommunications or Internet), shortages of supplies, equipment or transportation, whether or not such circumstances could have been foreseen.

8. Advertising

8.1. We shall always comply with and endeavour to maintain all relevant regulations relating to promotional and advertising materials on the Site.

9. Amendment to the General Business Terms and Conditions

9.1. We reserve the right to amend these Terms and Conditions at any time. All amendments will be posted online. Continued use of the Site constitutes acceptance of the revised Terms and Conditions.
